For Job Seekers:
For specific processing, such as when employers set questions like screener questions or assessments, NexGen can process your application materials submitted through our platform and your interview information when you participate in an interview facilitated by NexGen. The employer to whom you are applying controls these data.
NexGen is the controller of all other information that you provide when using our Services.
For Employers:
For specific processing, NexGen can process Job Seeker applications submitted through our platform and the data you provide to NexGen via Candidate Import. When you sign up for our Candidate Import service, you must agree to a Data Processing Agreement (DPA) with NexGen outlining the terms of our relationship.
NexGen is the controller of all other information that you provide when using our Services.
The NexGen controlling entity responsible for your information will depend on your location. It is important to note that the contracting entity indicated in our General Terms of Service may differ from the entity listed as a controller in this Privacy Policy. Please note that a publicly traded parent company directly or indirectly owns NexGen and its affiliates.

- Job Seeker: An individual searching for employment opportunities or information via NexGen's platform.
- Employer: Individuals and organizations seeking information related to hiring or human resources, seeking Job Seekers, or seeking to make available information regarding employment openings on their behalf or other’s behalf, including but not limited to agencies purchasing for multiple parties and employment agencies. An individual or entity using NexGen to post job listings or search for candidates.
- Personal Data: Any information related to an identifiable individual, such as name, email, IP address, and device information.
- Purpose: To enhance transparency in explaining what qualifies as personal data under the policy.
- Special Category Data: Any information that relates to an identified or identifiable individual and reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, data concerning health, sex, or sexual orientation. Sensitive information like race, ethnicity, health, or biometric data require extra protection under GDPR and similar laws.

- NexGen Messaging: NexGen may enable in-app messaging services, text messaging relay, and call relay services through our platform directly or through vendors to help facilitate contact between Employers and Job Seekers about a Job Listing.
- Relay Service: NexGen may provide two-way message proxy and relay services to the users of our NexGen products, including, but not limited to, NexGen Resume, NexGen Apply, Post a Job, private calling, and other electronic communication services, whether in the form of phone, text, video, or audio.
- Affiliates: Any entity that directly or indirectly controls is controlled by, is under common control of, or is with a NexGen entity now or in the future. "Control" for these purposes means significantly influencing the entity's operations.
The Scope of NexGen’s Privacy Policy
This Privacy Policy covers data that we collect through the NexGen Sites, directly from data subjects, or that we obtain from third parties. In cases where you follow a link to a third-party website, our Privacy Policy no longer covers you. That website’s privacy policy will govern any data collection or processing activity that takes place on that website. We only collect data on the NexGen Sites that display a direct link to this Privacy Policy.
Following our Terms, the NexGen Site is generally only for individuals aged 16 or over. However, some jurisdictions have different age restrictions, as outlined below.
In all jurisdictions, if you are under the age of majority in your jurisdiction, you must use the NexGen Sites under the supervision of your parent, legal guardian, or responsible adult, even if your age is above the permitted use age for that jurisdiction. - By creating a searchable profile through the NexGen platform, including when you upload a resume, you are requesting and authorizing NexGen to make your profile data available to third parties by our NexGen General Terms of Service. When you create a profile on NexGen, it is set to searchable by default. This means your profile data, including resume details, may be accessible to third parties such as Employers.
- Please be aware that employers and employer representatives can access your profile. At the same time, it is set to searchable, or to whom you apply with a non-searchable profile may choose to share your profile with additional parties. NexGen is not responsible for such sharing. Similarly, when you share your searchable profile directly via a personalized link, we cannot control who views your profile once that link is shared.
- You have the option to change your profile privacy settings at any time. If you do not wish for NexGen to make your profile data available to third parties without your direction, or if you prefer not to be contacted by Employers, you can set your profile to non-searchable. For more information about your profile, including the differences between searchable and non-searchable profiles and how to change your privacy settings, please refer to our FAQ.
- As we continue to enhance the NexGen platform, you may notice terminology such as ‘Employers can find you’ or ‘Employers can’t find you.’ These phrases are intended to improve user understanding and correlate to ‘Searchable’ and ‘Not Searchable,’ respectively.

NexGen provides users the ability to link Employer accounts. Linked users can be assigned specific roles, granting different access levels to candidate Personal Data within the primary account. If you are an Employer and invite other NexGen users to link their accounts to yours, you agree that these linked users may access all information in your account. Candidate Personal Data may include resume contacts, application materials, communications with applicants, actions taken by you or other linked users, timestamps of those actions, and billing information. If an Employer account is delinked, either by your choice or an administrator's action, you will lose access to all candidate Personal Data in the linked account.

In specific markets, NexGen may offer additional resume review services to assist Job Seekers in crafting and enhancing their resumes. This may include guidance on how applicant tracking systems process your resume, feedback on creating a more effective resume, or personalized resume review videos. This feedback is only accessible to you and is not shared with Employers.

- NexGen sends Job Seeker Personal Data to Employers based on the instructions of both Job Seekers and Employers. These transfers occur during the job search, application, and interview process. Job Seeker Personal Data sent to Employers is processed by NexGen’s Terms and those of the respective Employer. This may include delivering your application and additional candidate information, like your contact details, to various platforms that process Job Seeker Personal Data for the Employer, such as the Employer’s preferred Applicant Tracking System (ATS) or scheduling tool.
- Employers agree to comply with all relevant data protection regulations regarding the collection, processing, and storage of Personal Data and provide adequate measures to protect all data subject rights as required by applicable data protection laws.
- NexGen employer accounts linked to an employer’s domain may be shared with other organization members to facilitate onboarding new users to the corresponding employer account. Suppose you utilize NexGen with a company email but do not engage with our Services as part of your organization (e.g., searching and applying for jobs independently), and you wish to prevent this information from being shared with your organization. In that case, you should transfer your account to a personal email address. You may be able to update your email address from the account settings page, depending on your sign-in method. Please note that if your employer uses Single Sign-On (SSO) functionality on NexGen, you may be unable to update the email address associated with your NexGen account. For further assistance, please get in touch with your employer’s IT/HR administrator.
